These Terms of Service ("Terms") form a legally binding agreement between you ("you", "your") and ÉKAI NOIR CAKES & CO. LTD ("we", "us", "our"), a company registered in England & Wales (company number 16447782), whose registered office is at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ.
By creating an account or using The Baker's Suite (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.
The Baker's Suite is a web-based software service that helps home bakers manage recipes, costings, quotes, orders, customers, enquiries, food-safety compliance records, stock and finances.
It is a business tool; it does not provide legal, tax, accounting, or food-safety advice. You are responsible for ensuring that your use of the Service and the records you create meet your own legal and regulatory obligations.
New users receive a 14-day free trial with full access to the Service. No payment card is required to start the trial.
At the end of the trial period, access to the Service will be restricted unless you subscribe to a paid plan. We will not charge you automatically — you choose whether to subscribe and do so by initiating a payment yourself.
You can cancel your subscription at any time from the billing page inside the Service, or by emailing us. Cancellation takes effect at the end of your current billing period — you will continue to have access until then.
Refunds: We do not offer pro-rata refunds for unused portions of a billing cycle. If you believe you have been charged in error, contact us within 30 days and we will investigate.
Our handling of your personal data is set out in our Privacy Policy, which forms part of these Terms.
You retain ownership of all data you put into the Service. You can export your data at any time from the Service, and you can request deletion via Profile → Delete my account.
We will keep your data for as long as your account is active. After deletion, we may retain financial records for 6 years as required by UK tax law.
When you use the Service to communicate with your own customers (e.g. to send quotes, invoices, or enquiry responses), you are the data controller for your customers' personal data and we are a data processor. You are responsible for:

The Service, including its code, design, content, logos and branding, is the property of ÉKAI NOIR CAKES & CO. LTD and is protected by copyright, trade mark, and other intellectual-property laws. You receive a limited, non-exclusive, non-transferable licence to use the Service for your own business, for as long as your subscription is active.
You may download, print, and retain your own records created within the Service.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, except where required by UK law. Nothing in these Terms limits or excludes our liability for:
Subject to the above, our total aggregate liability to you under or in connection with these Terms shall not exceed the amount you have paid us in subscription fees during the 12 months immediately before the event giving rise to the claim.

These Terms are governed by the laws of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales, save that if you are a consumer resident elsewhere in the UK you may bring proceedings in your local jurisdiction.
